Terms of Use
The rules for using the GigTools website and app, in plain English wherever possible.
These Terms of Use (the "Terms") are an agreement between you and GigTools, LLC ("GigTools," "we," "us" or "our"). They cover your use of the website at gigtools.net (the "Website") and the GigTools® web app at app.gigtools.net (the "App"). Together, these are the "Services."
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you are using GigTools on behalf of a company or other organization, you confirm that you have authority to accept these Terms for it, and "you" includes that organization. If you don't agree, don't use the Services.

1. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract to use the App.
- Give us accurate information when you sign up, and keep it up to date.
- You are responsible for keeping your password secure and for everything that happens under your account. Tell us right away at support@gigtools.net (contact us) if you think someone has accessed your account without permission.
- Each account is for one person or business. Don't share your login. If others need access, use any team features we offer, or ask us.
2. The Services
GigTools helps live performers, public speakers and the people who represent them manage their gigs. Features include:
- your gig calendar and website calendar embed
- contacts and communication history
- gig details, including travel and flight status
- fees, deposits, balances and expenses
- performance agreements signed online
- email templates and automations, contact lists, booking campaigns and avails
- act pages and public event pages
We are always improving GigTools, so features may change, be added or be removed over time. If we remove a major feature you pay for, we will give you reasonable notice.
We work to keep the Services available and reliable, but we don't guarantee they will be uninterrupted or error-free. There may be downtime for maintenance, updates or events outside our control.
3. Your content
"Your Content" means everything you or your account users put into GigTools, including gigs, contacts, notes, bios, images, demo reel links, templates, messages, agreements and files.
- You own Your Content. We don't claim ownership of it.
- Your Content stays private to your organization. Other users can't see it unless you choose to share it. We never contact your clients or acts, never sell Your Content, and never use it for any booking business. Our staff access it only when you ask for help, to keep the Services secure and working, or when the law requires it.
- You give us permission to use it to run the Services. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content only as needed to provide, secure and improve the Services for you. This includes publishing the pages you choose to make public and sending the messages you ask us to send. This license ends when Your Content is deleted from the Services, except for backups for a limited time and records we are required to keep.
- You are responsible for Your Content. You confirm that you have all the rights and permissions needed to upload and use it, including any photos, videos, music, logos and information about other people. You also confirm that Your Content doesn't violate any law or anyone else's rights.
- Information about other people. When you add clients, bookers or other contacts, you are responsible for collecting and using their information lawfully. Our Privacy Policy explains how we handle it on your behalf.
- Back up what matters. We take reasonable steps to protect your data. Even so, keep your own copies of important information, such as signed agreements. You can export your data at any time.
4. Acceptable use
You agree not to, and not to let anyone else:
- break any law or regulation, or infringe or misappropriate anyone's intellectual property, privacy or other rights
- upload or send content that is unlawful, fraudulent, defamatory, harassing, hateful, sexually explicit or otherwise objectionable
- send spam, phishing or misleading messages, or use GigTools to contact people in a way that violates anti-spam or telemarketing laws
- impersonate anyone, or misrepresent your identity, credentials or affiliation
- upload malware, or interfere with or disrupt the Services, servers or networks
- probe, scan or test the vulnerability of the Services, or get around security, captcha or usage limits
- access the Services with bots, scrapers or other automated means, except through features or APIs we provide
- copy, modify, reverse engineer or create derivative works of the Services, except where the law expressly allows it
- resell, sublicense or provide the Services to others as a service bureau without our written permission
- use the Services to build a competing product
We may remove content or restrict accounts that we reasonably believe violate these Terms.
5. Emails, campaigns and avails
GigTools can send emails for you, including confirmations, agreements, booking campaigns and automated avails. These are sent through our email provider or through your own connected Gmail account. When you send messages through GigTools, you are the sender. You are responsible for:
- having a lawful basis to contact each recipient
- following anti-spam laws, such as the U.S. CAN-SPAM Act. This includes accurate sender and subject information, your physical mailing address in commercial messages where the law requires it, and honoring unsubscribe requests promptly.
- the content of every message you send
We may limit sending volume, pause campaigns or suspend sending features to protect deliverability and prevent abuse.
6. Text messages (GigTools Alerts)
Program: GigTools Alerts are transactional text messages from GigTools: reminders the day before a booked performance (date, time, venue, arrival time and day-of contact), notices when your tasks or booked gigs change, and flight delay alerts for travel to a gig. We don't send marketing texts. Details are on our Text messages page.
Who gets them: GigTools users who turn on text alerts and add their mobile number in Settings › My settings, and performers who gave their mobile number to the organization that booked them to receive gig reminders. If you use GigTools to book performers, you agree to add a performer's mobile number only if they gave it to you for coordinating their bookings, and to mark them "don't text" if they ask.
Frequency and cost: message frequency varies with your bookings and tasks, typically a few messages a week. Message and data rates may apply. Carriers aren't liable for delayed or undelivered messages.
Stopping and help: reply STOP to any message to stop receiving texts (you'll get one confirmation and no more). Reply HELP for help, or email support@gigtools.net (contact us). You can also turn texts off in Settings › My settings at any time. We don't share mobile numbers or text-messaging consent with third parties for their marketing; see our Privacy Policy.
7. Performance agreements and e-signatures
GigTools can generate performance agreements from your gig details and collect electronic signatures.
- GigTools is not a party to your agreements. Any agreement is between you and your client. You are responsible for its terms, for performing it, and for resolving any dispute about it.
- Not legal advice. Templates, sample clauses, blog articles and other content we provide are general information only. They are not legal, tax or financial advice. Have a qualified professional review your standard agreement.
- Electronic signatures. By signing electronically through GigTools, signers agree to do business electronically and intend their electronic signature to be legally binding. We keep a record of each signature, including the name, date, time and technical details. Whether a specific agreement is enforceable depends on its content and on applicable law.
8. Third-party services and integrations
The Services work with third-party services. These include Google (Gmail and Google Calendar), maps and address lookup, flight status data and payment processing. Your use of a third-party service is also governed by that provider's own terms and privacy policy. We aren't responsible for third-party services, and they may change or become unavailable.
- Information from third parties may be inaccurate. This includes flight delays and cancellations, maps and addresses. Always confirm important travel and event details directly with the airline, venue or client.
- When you connect a Google account, you authorize GigTools to access it within the permissions you grant, as described in our Privacy Policy. You can disconnect at any time.
9. AI help chat
Some plans include an AI help chat. Answers are generated automatically and may be inaccurate, incomplete or out of date. They are not professional advice, so use your own judgment and verify anything important. Don't use the chat to send content you don't have the right to share. We may set usage limits on the chat.
10. Plans, fees and payment
We may offer free and paid plans (such as a Pro plan). If you buy a paid plan:
- Pricing and features are shown when you subscribe. Prices don't include taxes unless stated, and you're responsible for applicable taxes.
- Billing. Paid plans are billed in advance on a recurring basis (for example, monthly or yearly) through our third-party payment processor. They renew automatically until you cancel. You authorize us and our payment processor to charge your payment method for each renewal.
- Cancellation. You can cancel at any time. Your plan stays active until the end of the current billing period and won't renew after that.
- Refunds. Except where required by law or stated at the time of purchase, payments are non-refundable, and we don't give credits for partial periods.
- Price changes. We'll give you advance notice of any price change, and it applies from your next renewal. If you don't agree, you can cancel before the change takes effect.
- Failed payments. If a payment fails, we may downgrade or suspend paid features until it's resolved.
- Free plans and trials may be changed or discontinued. When a trial ends, any paid plan you chose starts automatically unless you cancel first.
11. Our intellectual property
The Services belong to GigTools, LLC and its licensors. This includes the software, design, text, graphics, logos, the GigTools name and brand, and blog articles. They are protected by intellectual property laws. Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable right to use the Services for your own business purposes. We reserve all rights not expressly granted.
GigTools® is a registered trademark of GigTools, LLC. You may refer to GigTools by name, for example to say your pages are powered by GigTools, but you may not use the GigTools name or logo in a way that suggests we sponsor or endorse you, or as part of your own product, business or domain name, without our written permission.
You may share links to our blog articles and quote short excerpts with attribution and a link back. You may not republish whole articles without our permission.
12. Feedback
We love hearing ideas. If you send us suggestions or feedback, you allow us to use them without restriction or payment to you.
13. Suspension and termination
- You can stop using the Services and ask us to delete your account at any time.
- We may suspend or terminate your access if you materially violate these Terms, create risk or legal exposure for us or others, don't pay fees you owe, or if we stop offering the Services. Where reasonable, we'll give notice and a chance to fix the problem first.
- After termination, your right to use the Services ends. We will give you a reasonable opportunity to export Your Content, except where we terminated for serious violations or the law prevents it. We'll then delete it as described in our Privacy Policy.
Sections that by their nature should survive termination will survive. These include Your Content responsibilities, fees owed, intellectual property, disclaimers, limitation of liability, indemnification and governing law.
14. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. WE ALSO DON'T WARRANT THAT ANY INFORMATION (INCLUDING FLIGHT STATUS, MAPS OR AI ANSWERS) WILL BE ACCURATE, OR THAT USING THE SERVICES WILL RESULT IN ANY BOOKING, INCOME OR OTHER OUTCOME.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW:
- NEITHER GIGTOOLS NOR ITS OFFICERS, EMPLOYEES OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. THEY WILL ALSO NOT BE LIABLE FOR ANY LOST PROFITS, REVENUE, BOOKINGS, DATA OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
16. Indemnification
You agree to defend, indemnify and hold harmless GigTools and its officers, employees and agents from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from:
- Your Content
- messages you send through the Services
- your agreements with your clients
- your violation of these Terms or of any law or third-party right
17. Governing law and disputes
These Terms are governed by the laws of the State of Arizona and applicable U.S. federal law, without regard to conflict-of-law rules.
Before filing a claim, please contact us at support@gigtools.net (contact us) so we can try to resolve the issue informally. If we can't resolve it within 30 days, any lawsuit must be brought exclusively in the state or federal courts located in Maricopa County, Arizona. You and we both consent to the personal jurisdiction of those courts. Either party may bring a qualifying claim in small claims court.
18. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you by email or in the App before they take effect, and update the "Last updated" date above. If you keep using the Services after the changes take effect, you accept the updated Terms. If you don't agree, stop using the Services and cancel any paid plan.
19. General
- Entire agreement. These Terms and our Privacy Policy, together with any plan terms shown at purchase, are the entire agreement between you and us about the Services.
- Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a provision, that doesn't mean we waive it.
- Force majeure. We aren't responsible for delays or failures caused by events beyond our reasonable control.
- Notices. We may send notices to the email address on your account. You can send notices to support@gigtools.net (contact us).
